The Intrinsic Structure of Ecological Environmental Criminal Law Legislation

As China accelerates the formulation of the Ecological Environmental Code, there is an urgent need to scientifically refine the intrinsic structure of ecological environmental criminal law legislation. To this end, Xi Jinping Thought on Ecological Civilization should be upheld as the guiding principle, with legislative objectives such as sustainable resource utilization, a favorable environment, and ecological security. In addition, it is necessary to incorporate the principles of preventive measures and harmonious coexistence between humanity and nature. Guided by the value objectives of ecological civilization, the categorization of ecological environmental crimes and the clarification of their systemic structure should be advanced. While maintaining punitive sanctions, it is also necessary to strengthen preventive sanctions and introduce restorative sanctions, thereby establishing a more scientific criminal law sanction system for ecological environmental crimes. In pursuit of value objections of ecological civilization in ecological environmental criminal law legislation, it is essential to adopt the legislative framework of special criminal law as the institutional form.
